To gain a conviction in North Carolina for DWI, the prosecutor must prove that the driver of the vehicle was operating a motor vehicle with a blood alcohol concentration of .08 or higher or was impaired on Schedule I drugs or was appreciably impaired. Oftentimes, the prosecutor tries to prove this by a breath or blood test. The prosecutor also uses the arresting officer’s testimony on the driver’s performance on the NHTSA (National Highway Traffic Safety Administration) Standardized Field Sobriety Tests.
